These Terms and Conditions ("Terms") govern your use of the Gold Standard website and the HVAC services we provide. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please discontinue use of our website and do not engage our services.
Gold Standard reserves the right to update these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website with a revised effective date. Continued use of our website or services following any such update constitutes acceptance of the revised Terms.
1. Services Provided
Gold Standard is an HVAC contractor providing the following services to residential and commercial clients:

Heating system installation, repair, and maintenance, including furnaces, boilers, and heat pumps

Air conditioning installation, repair, and maintenance, including central air and ductless mini-split systems

Ventilation assessment and ductwork services

Indoor air quality evaluation and filtration solutions

HVAC system inspections and seasonal tune-ups
-
Emergency heating and cooling repair services

Thermostat installation and smart home HVAC integration
All services are performed by qualified technicians in accordance with applicable building codes and industry standards. Service availability may vary by location. Gold Standard does not guarantee service availability in all areas and reserves the right to decline service requests at its discretion.
2. Estimates and Pricing
Any estimate or quote provided by Gold Standard is based on information available at the time of assessment. Final pricing may differ from the initial estimate if additional issues are identified during service, if required parts or materials differ from what was originally scoped, or if conditions at the property affect the scope of work.
We will communicate any material changes to pricing before proceeding with additional work beyond the original scope. Estimates are not guarantees of final cost unless confirmed in a signed written service agreement. Verbal quotes are for informational purposes only and are not binding.
3. Scheduling and Appointments
Appointments are scheduled based on technician availability. We make every effort to honor confirmed appointment windows; however, scheduling may be affected by emergency service calls, weather conditions, or unforeseen delays. In such cases, we will contact you as promptly as possible to reschedule.
If you need to cancel or reschedule an appointment, please notify us at least 24 hours in advance. Cancellations made with less than 24 hours notice, or failure to be present at the time of a scheduled appointment, may result in a cancellation charge. Any applicable charge will be disclosed to you at the time of booking.
4. Payment Terms
4.1 Residential Services
Payment for residential HVAC repairs and installations is due upon completion of the service, unless other arrangements have been confirmed in writing prior to the start of work.
4.2 Maintenance Agreements
Customers enrolled in a service maintenance plan will be billed according to the schedule and terms outlined in their individual plan agreement. Maintenance plan pricing covers scheduled tune-ups and priority scheduling. It does not include parts, refrigerant, or repairs outside the scope defined in the plan unless separately agreed upon in writing.
4.3 Commercial Services
Commercial clients may be subject to separate billing schedules, net payment terms, or contract pricing as outlined in their service agreement with Gold Standard. In the absence of a written commercial agreement, standard residential payment terms apply.
4.4 Accepted Payment Methods
We accept the following forms of payment:

Electronic payment methods as specified at time of service
Unpaid balances outstanding beyond 30 days from the invoice date may be subject to a late fee at a rate permitted by applicable law, and may be referred to a collections process. The customer is responsible for any reasonable costs incurred in collecting overdue amounts, including attorney fees where permitted by law.
5. Warranties and Guarantees
5.1 Labor Warranty
Gold Standard warrants the quality of our workmanship as specified in your service agreement, installation contract, or written proposal. Labor warranty terms, including duration and coverage, may vary depending on the scope of work and will be clearly outlined in writing. If a defect in workmanship is identified within the applicable warranty period, we will return to correct the issue at no additional labor charge. This warranty applies only to work performed by Gold Standard and is non-transferable.
5.2 Equipment and Parts Warranty
Warranty coverage on HVAC equipment, parts, and components is governed by the terms of the applicable manufacturer's warranty. We will assist customers in understanding manufacturer warranty terms and support warranty claim submissions where possible. Gold Standard does not extend or supplement manufacturer warranties beyond their original terms, and is not responsible for manufacturer warranty decisions.
5.3 Warranty Exclusions
Our labor warranty does not apply to issues arising from: customer misuse, neglect, or improper operation of the HVAC system; failure to follow recommended maintenance schedules; unauthorized modifications or repairs made to the system by a third party after our service; normal wear and tear; or damage caused by external factors including power surges, flooding, fire, or structural deficiencies. Warranty coverage is void if the system is altered, serviced, or tampered with by anyone other than Gold Standard personnel during the warranty period without our prior written consent.
6. Customer Responsibilities
To ensure the safe and effective delivery of HVAC services, customers agree to:

Provide accurate and complete information about the property, existing HVAC systems, and the nature of the issue being reported

Ensure technicians have safe, clear, and unobstructed access to HVAC equipment, utility shutoffs, electrical panels, and all relevant work areas

Disclose any known hazardous conditions on the property, including but not limited to mold, asbestos, or carbon monoxide risks, prior to service

Follow all post-service care and operating instructions provided by our technicians

Notify Gold Standard promptly if any concerns arise following the completion of service
Failure to fulfill these responsibilities may void applicable warranties or limit our liability for resulting issues.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Gold Standard's total liability for any claim arising from services rendered, or failure to render services, is limited to the total amount paid by the customer for the specific service giving rise to the claim.
We are not liable for indirect, incidental, special, or consequential damages, including but not limited to property damage resulting from pre-existing conditions, loss of use of heating or cooling systems, increased utility costs, or business interruption, even if advised of the possibility of such damages.
Nothing in these Terms limits our liability for damages resulting from gross negligence, willful misconduct, fraud, or any liability that cannot be limited or excluded under applicable law.
8. Indemnification
You agree to indemnify, defend, and hold harmless Gold Standard, its owners, technicians, employees, contractors, and agents from and against any claims, damages, losses, costs, or expenses (including reasonable attorney fees) arising out of or related to: your misuse of our services; your failure to provide accurate information about your property or HVAC system; your violation of these Terms; or your breach of any applicable law or regulation. This indemnification obligation will survive the termination of these Terms.
9. Third-Party Products and Referrals
Gold Standard may recommend or install third-party HVAC equipment, thermostats, air filtration systems, or related products. Our responsibility is limited to the quality of our installation workmanship. We are not responsible for the performance, safety, defects, or warranty terms of third-party products after proper installation. All product-related warranty claims and performance concerns should be directed to the applicable manufacturer.
10. Website Use
10.1 Permitted Use
You may use the Gold Standard website to learn about our services, request quotes, and contact our team. You agree not to use the website for any unlawful purpose, to transmit harmful or malicious content, or in any manner that could damage, disable, or impair the website or interfere with other users' access to it.
10.2 Accuracy of Information
We make reasonable efforts to ensure that the information on our website is accurate and current. However, we do not warrant that all content is free from errors, omissions, or outdated information. Service availability, pricing, coverage areas, and product offerings are subject to change without notice. We encourage you to contact us directly to confirm current information before making decisions based on website content.
10.3 Intellectual Property
All content on the Gold Standard website, including logos, trademarks, service names, text, images, and service descriptions, is the property of Gold Standard or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or otherwise use any content from our website without prior written permission from Gold Standard.
11. Privacy
Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By agreeing to these Terms, you also acknowledge that you have reviewed our Privacy Policy and agree to its terms. Please review our Privacy Policy for a full explanation of how we collect, use, and protect your personal information.
12. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms or our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Atlantic County, New Jersey.
13. Dispute Resolution
In the event of a dispute arising from these Terms or our services, we encourage you to contact us directly so that we can work toward a prompt and fair resolution. If a dispute cannot be resolved informally within 30 days of written notice from either party, both parties agree to submit the dispute to non-binding mediation before a mutually agreed-upon mediator, prior to initiating any formal legal proceeding. The costs of mediation will be shared equally between the parties, unless otherwise agreed in writing. Nothing in this section prevents either party from seeking emergency or injunctive relief from a court of competent jurisdiction where necessary to prevent irreparable harm.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions of these Terms will continue in full force and effect.
15. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any written service agreements executed between you and Gold Standard, constitute the entire agreement between the parties with respect to the subject matter herein and supersede all prior or contemporaneous representations, understandings, or agreements, whether written or oral.
